2 OUR PRODUCTS

The images of the Products on our website are for illustrative purposes only. Although JocieJuritzCollection has made every effort to display the colours accurately, we cannot guarantee that your device’s display of the colours accurately reflects the colour of the Products. Your Products may vary slightly from those images.

Although JocieJuritzCollection have made every effort to be as accurate as possible, all sizes and measurements indicated on our website are approximate.

JocieJuritzCollection reserves the right to change the assortment of Products offered and to limit the quantity of Products that may be purchased at any time, without prior notice.

All Products shown on our website are subject to availability. We will inform you by email as soon as possible if the Product you have ordered is not available and we will not process your order.

5 JOCIEJURITZCOLLECTION’S OBLIGATIONS TO YOU

JocieJuritzCollection is under a legal duty to supply Products which conform with a Contract, including that the Products are as described and match information we provided to you and any model seen or examined by you, are of satisfactory quality and are fit for any particular purpose made known to us. Nothing in these Terms will affect these legal rights. Advice about your legal rights as a consumer is available from your local Citizens’ Advice Bureau or Trading Standards office.

6 HOW THE CONTRACT IS FORMED BETWEEN YOU AND JOCIEJURITZCOLLECTION

Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

After you place an order, you will receive an email from JocieJuritzCollection acknowledging that we have received your order. We will confirm our acceptance to you by sending you a confirmation email that confirms that the Products have been ordered. The Contract between us will only be formed when we send you the confirmation email.

If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available, or because of an error in the price on our website, we will inform you of this by email and we will not process your order. If you have already paid for the Products, we will refund you the full amount as soon as possible.

7 YOUR RIGHT OF RETURN AND REFUND

You have the right to cancel a Contract during the period set out below. This means that during that period, if you change your mind, or for any other reason you decide you do not want to keep a Product, you can notify us of your decision to cancel the Contract and receive a refund.

Your right to cancel a Contract starts from the date of the email confirmation, which is when the Contract between us is formed. You then have a period during which you may cancel a Contract and return the Product, and that period continues until the end of 30 days starting from the day after you receive the Products (‘the return period’).

To cancel a contract, please email returns@jociejuritzcollection.com, including your order number in the subject line.

All Products must be returned in their original condition, including undamaged packaging. If products are returned damaged, scuffed or worn on the sole or any other areas, we reserve the right to refuse the return. Please note that shipping and handling charges for return merchandise are not refundable unless we have made a shipping error.

If you request a return within the return period we will provide you with a prepaid return label. Please note: You don’t pay the prepaid return cost separately, it is deducted from your refund. By using this label you consent to the deduction of the return postage cost from your refund.

We will process the refund due to you as soon as possible and in any case within 30 days from the day we receive the Products back. We will make the refund using the same means of payment as you used for the initial purchase, unless you expressly agree otherwise.

As a consumer, you will always have legal rights regarding cancellation in relation to Products that are faulty or not as described. These legal rights are not affected by anything in these Terms. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards Office.

8 DELIVERY

All orders are shipped using a Track and Trace delivery service. We strongly recommend that you choose a postal option offering a signed-for delivery. Please note that if you choose a delivery option not requiring a signature, JocieJuritz Collection and our delivery partners cannot be held responsible for any loss or damage that may occur once your order has been delivered.

Your order will be fulfilled by the estimated delivery date set out in the email confirmation, unless there is an event outside our control. Please see our Terms of Use and Conditions of Sale for more information If we are unable to meet the estimated delivery date because of an event outside our control, we will contact you with a revised estimated delivery date.

Delivery will be completed when we deliver the Products to the address you gave us. The Products will be your responsibility from the completion of delivery.

9 PRICES

The prices of the Products will be as quoted on our website from time to time. We take all reasonable care to ensure that the prices of the Products are correct at the time of publication. All prices for purchases in the UK include VAT.

Any changes in price will not affect any order which we have confirmed with an email confirmation.

The price of a Product does not include any applicable delivery charges. Delivery prices are calculated at checkout based on destination.

It is always possible that, despite our best efforts, a product listed on our site may be incorrectly priced. If a product’s correct price is less than our stated price we will charge the lower amount. If a product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection.

10 DUTIES & TAXES

We ship DDU (Delivery Duty Unpaid). Your order may be liable for local duty or other taxes before it can be released from customs for final delivery. JocieJuritzCollection shall not be liable for any residual additional or unforeseen import taxes, duties, or any other associated charges, which must be paid by the customer.

Any orders returned to us due to non-payment of local duty will be refunded LESS the cost of the return postage to us.

11 PAYMENT

The total cost of your order will be the purchase price of the product(s) plus delivery/shipping fees.

You confirm that the credit/debit card or payment method that is being used is yours and that all details you provide to us in respect thereof including, without limitation, name and address details are complete, correct and accurate. You further confirm that the credit/debit card is valid and the inputted payment details are correct. All credit/debit cardholders and payment account holders are subject to validation checks and authorisation by the card issuer or payment method provider. If the issuer of your card or payment method refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal.

We are not responsible for any charges or other amounts which may be applied by your card issuer or bank or payment method provider as a result of our processing of your credit/debit card payment or other methods of payment in accordance with your order or as a result of the seller of the Product(s) being located in the United Kingdom.

If your credit/debit card or payment method is not denominated in the currency of your purchase indicated on www.jociejuritzcollection.com, the final price may be charged in the currency of your card or account. Such final price is calculated and charged by your card issuer or bank or payment method provider and therefore we shall not be responsible for any cost, expense, charge or other liability which may be incurred or suffered by you as a result of your card issuer or payment method provider charging you in a different currency other than the currency of your purchase as displayed on the www.jociejuritzcollection.com.

12 LIABILITY

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the Contract.

We only supply the Products for domestic or private use. You agree not to use a Product for any commercial, business or resale purpose, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the Products (including the right to receive Products which are as described and match information we provided to you and any sample or model seen or examined by you, of satisfactory quality, and fit for any particular purpose made known to us, and for defective products under the Consumer Protection Act 1987.

13 EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an event outside our control. An event outside our control means any act or event beyond our reasonable control, including without limitation materials or labour shortages, supply-chain delays, coronavirus-related transportation delays, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster, or failure of public or private telecommunications networks, or impossibility of the use of shipping, aircraft, motor transport or other means of public or private transport.

If an event outside our control takes place that affects the performance of our obligations under a Contract:

(a) We will contact you as soon as reasonably possible to notify you; and

(b) Our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control. Where the event outside our control affects our delivery of Products to you, we will arrange a new delivery date with you after the event outside our control is over.

When we refer in these Terms to “in writing,” this will include email.

16 OTHER IMPORTANT TERMS

A Contract is between you and us. No other person shall have any rights to enforce any of its terms.

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

However, if you are resident of any other European Union country you will benefit from mandatory consumer provisions of, and legal rights available to you under, the laws of that country. Nothing in these Terms of Use affects your rights to rely on these local law mandatory consumer provisions and legal rights. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. 17 IF YOU ARE A BUSINESS

If you are a business, the following terms apply instead of the corresponding terms above)

Liability (applying instead of clause 12):

We only supply the Products for internal use by your business, and you agree not to use the Product for any resale purposes.

We do not limit in any way our liability for:

Death or personal injury caused by our negligence;

Defective products under of the Consumer Protection Act 1987;

Fraud or fraudulent misrepresentation; or

Breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession).

We will under no circumstances be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise arising under or in connection with the Contract for:

Any loss of profits, sales, business or revenue;
Business interruption;
Loss or corruption of data, information or software;
Loss of anticipated savings;
Loss of business opportunity, goodwill or reputation; or
Any indirect or consequential loss or damage.

Our total liability to you in respect of other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the purchase price of the Products.

Except as expressly stated in these Terms, we do not give any representation, warranties or undertakings in relation to the Products. Any representation, condition or warranty that might be implied or incorporated into these Terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.

Communications Between Us (applying instead of clause 14):

When we refer in these Terms to “in writing,” this will include email.

Any notice or other communication given by you to us, or by us to you, under or in connection with the Contract shall be in writing and shall be delivered personally, sent by pre-paid first class post or other next working day delivery service, e-mail, or posted on our website.

A notice or other communication shall be deemed to have been received: if delivered personally, when left at our registered office; if sent by pre-paid first class post or other next working day delivery service, at 9.00 am on the second Business Day after posting; if sent by email, one Business Day after transmission; or, if posted on our website, immediately.

In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.

The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.
